Welcome to the website of Hands-On Culinary Creations, LLC ("Company," "we," "us," or "our"), a Florida limited liability company located in Leon County, Florida. These Terms and Conditions ("Terms") govern your access to and use of our website at [www.yourwebsite.com] (the "Site"), including any content, functionality, and services offered on or through the Site (collectively, the "Services").

By accessing or using the Site, you agree to be bound by these Terms. If you are accessing the Site on behalf of a minor (e.g., for class registration), you represent that you are the parent or legal guardian of that minor and have the authority to bind them to these Terms under Florida law (Fla. Stat. § 743.041). If you do not agree with these Terms, you must not use the Site.

We reserve the right to modify these Terms at any time. Changes will be posted on the Site with an updated "Last Updated" date. Your continued use of the Site after changes constitutes acceptance of the revised Terms.

1. Eligibility and User Responsibilities
  • Age Restrictions: The Site and our culinary cooking classes ("Classes") are intended for users 18 years or older, or for parents/guardians registering middle or high school students (ages 11-18). Minors under 13 are prohibited from providing personal information without verifiable parental consent, in compliance with the Children's Online Privacy Protection Act (COPPA, 15 U.S.C. §§ 6501-6506).

  • Prohibited Conduct: You agree not to: (a) use the Site for any unlawful purpose; (b) post harmful, offensive, or infringing content; (c) interfere with the Site's functionality (e.g., via viruses or unauthorized access); or (d) impersonate others. We may suspend or terminate access for violations.

  • Accuracy of Information: You must provide accurate information during registration or bookings. We are not responsible for errors in user-submitted data.

2. Class Registration and Payments
  • Registration Process: To enroll in a Class, you must complete the online form, agree to these Terms, and electronically sign the Liability Waiver and Release of Claims for Minors (available here or during checkout). Registration is not complete until payment is received and the Waiver is signed by a parent/guardian.

  • Payments: All fees are non-refundable except as stated in our refund policy (see Section 7). Payments are processed securely via [e.g., Stripe/PayPal—specify your processor]. You authorize us to charge your payment method for the full amount. Prices are in USD and exclude taxes (Florida sales tax may apply under Fla. Stat. § 212.05).

  • Group Projects and Risks: Classes involve hands-on group activities like cutting/slicing with knives, using kitchen equipment, and handling hot oils, as detailed in the Waiver. By registering, you acknowledge the risks outlined in Section 1 of the Waiver and assume them voluntarily.

  • Capacity and Availability: Classes are limited to [e.g., 12 students]. We reserve the right to cancel or reschedule for low enrollment, weather, or unforeseen events, with full refunds if canceled.

3. Intellectual Property
  • Ownership: The Site and all content (e.g., recipes, photos, videos of Classes) are owned by the Company or our licensors and protected by U.S. copyright, trademark, and other laws (e.g., 17 U.S.C. § 501).

  • Limited License: We grant you a non-exclusive, non-transferable, revocable license to view and use the Site for personal, non-commercial purposes. You may not reproduce, distribute, or create derivative works without written permission.

  • User Content: If you submit content (e.g., reviews or photos), you grant us a perpetual, royalty-free license to use it for promotional purposes, as per the Media Release in the Waiver (Section 5). You retain ownership but waive moral rights.

4. Privacy and Data Collection

Your use of the Site is also governed by our Privacy Policy, which describes how we collect, use, and protect personal information (e.g., student allergies or guardian emails). We comply with Florida's consumer protection laws, including the Florida Deceptive and Unfair Trade Practices Act (FDUTPA, Fla. Stat. § 501.201 et seq.), and federal laws like COPPA. For minors' data, we require parental verification. Do not submit sensitive health information unless required for Class safety.

5. Disclaimers and Limitation of Liability
  • No Warranties: The Site and Services are provided "as is" and "as available" without warranties of any kind, express or implied, including merchantability or fitness for a particular purpose. We do not guarantee uninterrupted access or error-free operation.

  • Limitation of Liability: To the fullest extent permitted by Florida law, the Company, its officers, employees, and affiliates (collectively, "Released Parties") shall not be liable for any indirect, incidental, consequential, special, or punitive damages arising from your use of the Site or participation in Classes, including but not limited to loss of data, injury, or death (as expressly released in the Waiver's Section 3). Total liability shall not exceed the amount paid for the relevant Class. This applies even if advised of the possibility of such damages.

  • Force Majeure: We are not liable for delays or failures due to events beyond our control (e.g., natural disasters, pandemics).

6. Indemnification

You agree to indemnify, defend, and hold harmless the Released Parties from any claims, losses, liabilities, damages, costs, or expenses (including reasonable attorneys' fees) arising from your use of the Site, violation of these Terms, or the actions of any minor you register (e.g., negligence during group projects). This includes claims related to the inherent risks of Classes, as assumed in the Waiver.

7. Refunds and Cancellations
  • Refunds: Full refunds are available up to [e.g., 7 days] before the Class start time, minus a [e.g., $10] processing fee. No refunds after that, except for Company cancellations (full refund issued).

  • Cancellations: You may cancel via [email/contact form]. We may cancel for safety reasons (e.g., failure to disclose allergies) with pro-rated refunds. All disputes follow the governing law below.

8. Governing Law and Dispute Resolution

These Terms shall be governed by the laws of the State of Florida, without regard to conflict of laws principles. Any disputes arising from these Terms or the Site shall be resolved exclusively in the courts of Leon County, Florida, in accordance with the dispute resolution provisions in the Waiver (Section 8). You waive any objection to venue or jurisdiction. For small claims under $8,000, Leon County small claims court applies.

9. Miscellaneous
  • Severability: If any provision is held invalid under Florida law, the remainder remains in effect.

  • Entire Agreement: These Terms, along with the Waiver and Privacy Policy, constitute the full agreement between you and the Company.
