Privacy Policy

Last Updated: September 19, 2025

At Hands-On Culinary Creations, LLC ("Company," "we," "us," or "our"), a Florida limited liability company located in Leon County, Florida, we are committed to protecting your privacy. This Privacy Policy explains how we collect, use, disclose, and safeguard personal information when you access our website at [www.handsonculinarycreations.com] (the "Site"), register for our culinary cooking classes ("Classes"), or interact with our services (collectively, the "Services").

Our Services are designed for families, including middle and high school students (ages 11-18) and their parents/guardians. We prioritize the privacy of minors and comply with the Children's Online Privacy Protection Act (COPPA). If you are a parent or guardian registering a minor, you consent to our collection and use of their information as described below.

By using the Site or Services, you consent to the practices outlined in this Policy. If you do not agree, please do not use the Site or provide information. We may update this Policy; changes will be posted here with an updated "Last Updated" date. Continued use after changes constitutes acceptance.

1. Information We Collect

We collect information to facilitate safe, engaging Classes (e.g., disclosing allergies for group projects) and improve our Services. Types of information include:

  • Personal Information from Registrations: When you register for a Class via the Site or forms, we collect:

    • For Students (minors): Full name, age/grade, school, date of birth, address, phone, email, emergency contact, and health details (e.g., allergies to nuts/shellfish, dietary restrictions, or medical conditions disclosed in the Liability Waiver).

    • For Parents/Guardians: Full name, relationship to student, address, phone, email, and payment details (e.g., credit card via secure processor).

  • Media and User-Generated Content: Photos, videos, or statements of students during Classes (e.g., group cooking projects), as captured by instructors. Per the Media Release in Section 5 of the Liability Waiver and Release of Claims for Minors (agreed to during registration), you grant us perpetual, royalty-free rights to use this for promotional purposes without further consent.

  • Usage Data: Automatically collected via cookies, server logs, or analytics tools (e.g., IP address, browser type, pages visited, time spent). We do not track sensitive health data beyond what's voluntarily disclosed for Class safety.

  • Other: Communications (e.g., emails about Class updates) and feedback (e.g., reviews). We do not collect information from children under 13 without verifiable parental consent under COPPA.

2. How We Use Your Information

We use information for legitimate business purposes, always with a focus on safety for youth participants:

  • Class Operations: To confirm registrations, assign groups, accommodate allergies (e.g., avoiding cross-contamination with hot oils), and provide supervision as outlined in the Waiver's Acknowledgment of Risks (Section 1).

  • Communications: Sending confirmations, reminders, or post-Class surveys via email/phone.

  • Promotions and Media: Using student photos/likenesses in marketing (e.g., website, social media), as authorized in the Waiver's Media Release (Section 5). No compensation is provided.

  • Improvements: Analyzing usage data to enhance the Site (e.g., popular recipes) or comply with health guidelines.

  • Legal Compliance: Responding to subpoenas or protecting rights under Florida law (e.g., FDUTPA).

We do not sell your personal information. For minors' data, uses are limited to Class necessities, with parental oversight.

3. How We Share Your Information

We share information only as necessary and with safeguards:

  • Service Providers: With trusted third parties (e.g., payment processors like PayPal, Venmo, Google and Apple Pay) under strict confidentiality agreements. They are prohibited from using data for their own purposes.

  • Legal Requirements: If required by law (e.g., Florida Department of Health inquiries) or to protect safety (e.g., sharing allergy info with instructors).

  • Business Transfers: In a merger or sale, data may transfer to the new entity.

  • With Consent: For media use under the Waiver, or if you opt-in for newsletters.

We do not share sensitive student data (e.g., from Waiver disclosures) beyond Class staff. No international transfers occur without equivalent protections.

4. Data Security

We implement reasonable administrative, technical, and physical safeguards to protect information (e.g., encryption for payments, secure servers). However, no system is 100% secure, and we cannot guarantee absolute protection against breaches. In case of a data incident, we will notify affected users as required by Florida law (Fla. Stat. § 501.171) and provide steps to mitigate harm.

5. Your Rights and Choices

Under applicable laws, you have rights regarding your information:

  • Access/Update/Delete: Email us to request access, corrections, or deletion (e.g., remove a student's photo from promotions, subject to Waiver rights). For minors, parents/guardians control these rights.

  • Opt-Out: Unsubscribe from emails via links; opt out of media use by notifying us in writing before the Class (overrides Waiver only if received timely).

  • COPPA for Minors: Parents can review, delete, or revoke consent for a child's data at any time. We verify parental identity (e.g., via credit card match) before changes.

  • Do Not Track: We do not respond to browser "Do Not Track" signals but honor opt-outs for cookies.

Requests are processed within 30 days; contact us. Florida residents have additional rights under FDUTPA for unfair practices.

6. Cookies and Tracking Technologies

The Site uses cookies for functionality (e.g., session management) and analytics (e.g., Google Analytics). You can manage preferences via browser settings. Third-party links (e.g., to social media) have their own policies—we are not responsible for them. For EU/CA users, we comply with GDPR/CCPA where applicable.

7. Children's Privacy

Our Services involve minors but require parental involvement for registration. We never condition participation on excessive data collection. Per COPPA, we obtain verifiable parental consent (e.g., via signed Waiver and payment verification) before collecting persistent identifiers from under-13s.
